It was a = crushing and=20 humiliating legal defeat for the cult that is infamous around the = world=20 for its outrageous litigation tactics. Over the past 22 years = Scientology=20 spent an estimated 140 million in and out of the court in its = efforts to=20 crush a former member, Lawrence Wollersheim, and his legal=20 teams.

The Wollersheim v. Church of Scientology of = California (CSC)=20 litigation wound its way though the LA Superior Court, the = California=20 Appellate and Supreme courts as well as the US Supreme court = almost a half=20 a dozen times. In the first landmark Wollersheim decision, = Scientology=92s=20 counseling practices were found to be dangerous in the first jury = decision=20 of the LA Superior Court. These dangerous counseling practices = were also=20 found to be the cause of Lawrence Wollersheim being driven to the = brink of=20 insanity. 

Thereafter, Scientology filed numerous = malicious=20 and tangential legal actions designed to inhibit Wollersheim right = of due=20 legal process and to exhaust his financial resources so that he = could not=20 carry on his case. The California court saw this new abuse and = fined=20 Scientology separately $500,000 in what is known as a SLAPP = lawsuit=20 (Strategic Lawsuits Against Public Participation.) This SLAPP fine = was the=20 highest fine ever paid for such a suit in = California. 

In=20 another ill-conceived effort to avoid paying the judgment = Scientology=20 stripped an estimated 500 million dollars from the Church of = Scientology=20 of California and transferred its assets to other corporations in = the=20 Scientology corporate umbrella. To collect this judgment from the = new=20 Scientology corporations that had received the money, Wollersheim = and his=20 legal team filed a new collection lawsuit naming the Church of = Scientology=20 International (CSI) and religious Technology Corporation (RTC) as=20 responsible for paying the Wollersheim judgment because of their = receipt=20 of the CSC assets.

On 9th May 2002, just before minutes = before CSI=20 and RTC were to appear in court Scientology hurriedly delivered an = $8,674,643 cashiers check to the LA superior court clerk. This = stopped=20 having any additional evidence presented in court that could have = exposed=20 Scientology=92s lack of corporate integrity, and could have = exposed=20 Scientology=92s controversial IRS charitable tax exemption to = review and=20 potential repeal as well as stopped the very real risk that = Scientology=92s=20 top executives could soon being put in jail for corporate and = asset=20 fraud. 

During the original 5-month jury trial in the = LA=20 Superior court in 1986 Scientology had almost 25,000 members = picketing the=20 courthouse carrying signs saying =93Not one thin dime for = Wollersheim=94 and=20 =93We will NEVER pay.=94 David Miscavige, the cult=92s current = leader and former=20 executive in CSI and RTC at the time of the (CSC) transfers, as = well as=20 other top Scientology cult leaders repeatedly vowed to members = that=20 nothing could ever force them to pay the Wollersheim judgment and = they=20 would fight the judgment forever no matter how much it costs or = what the=20 sacrifice.

After today=92s last minute payment it would = appear that=20 what David Miscavige and Scientology=92s other senior executives = were=20 actually saying was that they would only stonewall on the payment = up to=20 that point at which they were in danger of exposing themselves = personally=20 for potential felonies. And that they wanted, at all costs, to = avoid=20 Scientology=92s controversial IRS tax-exempt status grant being = exposed in a=20 court of law to evidence that could cause its=20 repeal. 

Scientology leaders are now faced with having = to=20 concoct a story for their current members explaining the painfully = obvious=20 incongruity of their actions. They also have to now contend with = the=20 floodgates being thrown wide open for thousands of new lawsuits = being=20 filed by emboldened former members who lost hundreds of thousands = of=20 dollars to Scientology and/or were also harmed by Scientology=92s = outrageous=20 counseling tactics. 

In an exclusive for interview for = FACTNet=20 Lawrence Wollersheim said the following about this long overdue = and hard=20 won victory:

=93It is my=20 opinion that there are hundreds of thousands of people all = over the=20 US, Europe and South America who have been destroyed by this = cult and=20 then intimidated into silence. But, I now do not think that = these=20 people will remain silent any longer. 

I believe = that they=20 see this abusive cult has been beaten by the power of the law = and=20 patience. I hope that they will begin immediately calling = their=20 lawyers to use the full power of the law get their lives back = and seek=20 restitution as well. I also believe that after this court = victory,=20 former members who were intimidated into silence about = criminal acts=20 they were coerced to commit while in Scientology will come = forward and=20 speak with the proper government officials.

It took me = 22 years=20 of using the slow but steady power of law to enforce justice = upon this=20 dangerous cult. There were times when I thought I could not go = on any=20 longer. But then I would remember the many people who have = lost their=20 lives in Scientology such as Lisa McPherson (a current = Scientology=20 wrongful death case in Florida.). These people would have no = voice if=20 someone did not win a Scientology case. 

I = remembered=20 Medger Evers wife who fought for 32 years and finally got the = killers=20 of her husband (the civil right worker) to trial. I thought of = the=20 families for the four African American teens in Atlanta who, = after 39=20 years of persistence using the force of the law, finally got = the=20 fourth Ku Klux Klan member suspected in their deaths to=20 trial.

When I saw the courage, persistence and = dedication these=20 individuals displayed in using the law to effect justice I = told myself=20 to stop being such a wimp and that I was only at the 12, 18, = 20, and=20 22 year mark. These numbers were nothing compared to the 32 = years that=20 Medger=92s wife fought. What also sustained me in fighting for = justice,=20 no matter the level of threat or intimidation, was my faith in = a=20 higher, infinite and benevolent power.

The most = important thing=20 I have learned in this ordeal is that true justice is not the = law. Nor=20 is it the judges or courts. True justice is that sense of = fairness=20 that we all have in our hearts. It is that which gives us the = power to=20 ensure justice for others and the strength to demand justice = for=20 ourselves against all odds.

The most important thing I = could=20 say to others or to social advocacy groups that are facing or=20 considering cult - litigation, or bringing lawsuits against = wealthy=20 corporations like cigarette companies or fighting the = governments that=20 are polluting our environment or committing financial or other = criminal acts is that they should use the legal system and be = patient.=20 Do not be intimidated into silence. Do not let the wealth or = the size=20 of your opponent dissuade you. At the end of the day, the = power of=20 justice sought through law and patience dwarfs any opposing = force or=20 party. 

The rewards for enforcing justice are = many. If you=20 are a victim, justice is the miracle healer that accelerates = the=20 process far beyond just therapy. When a victim turns the = tables on its=20 former oppressor using the legal system they no longer remain = a=20 victim. The process transforms them psychologically and = empowers them=20 emotionally. There are also new laws like the SLAPP laws that = protect=20 the weaker or poorer parties from wealthy adversaries that are = trying=20 to punish them for speaking out or working for a better world. = This is=20 the good news.

Lastly, I want thank all of the lawyers = (Charles=20 O'Reilly, Leta Schlosser, Ford Greene, Craig J. Stein, Dan = Leipold,=20 Mark Goldowitz and the legal teams at Cummins and White as = well as=20 several firms who assisted at various stages of the 22 years = of=20 litigation) and former members and all the family friends and = other=20 people who, as a team, forced this ruthless cult to comply = with the=20 law. It could not have been done other than as a = team.

I=20 promise that everything that Scientology sought to hide from = public=20 scrutiny in my case (by stopping the hearings with their = $8,760,000=20 payment to the court) will go to the proper government = authorities.=20 Everything in my case that can be made available to other new = cases=20 suing Scientology will be made available as soon as=20 possible.

It is quite a paradox that the cult that = vowed it=20 would never pay me one thin dime has now paid over 86 million = thin=20 dimes not even including the $500,000 they paid=20 earlier.=94

(Scientology has = paid 10 of=20 millions of dollars in past secret settlements but because of gag = order=20 and confidentially settlement terms none of the current or former = members=20 ever hear about this.)

Scientology=92s=20 predictable and slanderous response to the Wollersheim defeat and = payment=20 publicity

After the Wollersheim story hit the media, in = an=20 effort to divert media investigation and attention away for the = real=20 reasons Scientology paid the 8.6 million dollars into the court,=20 Scientology released a written statement implying Scientology lost = the=20 case because of dubious expert testimony and that they are paying = the=20 Wollersheim because it is difficult to deal with someone with a = bi-polar=20 disorder. They also said that they want to put this chapter behind = them. 

They have been telling news media that Lawrence = Wollersheim had this history of bi-polar disorder before entering=20 Scientology.

What they are doing is a highly transparent = tactic=20 they teach their intelligence operatives in cult manuals that were = seized=20 in the FBI raid on their headquarters (when many of their = executives went=20 to jail.) 

The tactic is called "dead agenting". The = oldest=20 and most tired form of "dead agenting" is saying, or implying, = that the=20 target of "dead agenting" is mentally unbalanced.

The = Wollersheim=20 trial record, and all expert testimony given at trial, = conclusively states=20 that there was no bi-polar disorder in Wollersheim before = Scientology used=20 it outrageous counseling tactics on Wollersheim. 

The = court=20 record further states that the bi-polar disorder, which = Wollersheim=20 suffered, was a direct result of the dangerous nature of = Scientology=92s=20 counseling practices applied to Wollersheim.

Dr. Singer also = testified how=20 respondent ... not only had been induced into a severe bipolar = disorder,=20 but also suffered from panic attacks, psychogenic amnesia, and a=20 post-traumatic stress disorder.
