Criminal case - criminal law. In this prosecution for the 1976 murder of a member of the American Indian Movement, the district court did not err in admitting evidence regarding the activities of the group, including its violent confrontations with the government, as the evidence was relevant to establishing the motive for the victims's murder - the group's belief that she was acting as a government informant; for similar reasons, it was proper to admit certain hearsay evidence that the defendant and others believed the victim was an informant, as well as hearsay that the victim feared for her life because of the accusation; claim of ineffective assistance of counsel was not fully developed and should be raised in a Section 2255; evidence was sufficient to show defendant aided and abetted the killing of the informant, with malice aforethought and with premeditation.
